Terms of Service

These Terms of Service ("Terms") govern your access to and use of StoryPlan ("Service") provided by Nitwit AB ("we," "our," or "us"). By accessing or using StoryPlan, you agree to be bound by these Terms.

By creating an account and using StoryPlan, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use StoryPlan.

StoryPlan is an AI-powered tool that helps entrepreneurs and creators discover and communicate their authentic story through:

• Guided reflection questions
• AI-powered coaching conversations (using Anthropic Claude)
• Personal journal for tracking insights
• Communication planning tools

StoryPlan is provided "as is" and is intended for personal and professional development purposes.

• You must be at least 18 years old to use StoryPlan
• You must provide accurate information during sign-up
• You are responsible for maintaining the security of your account

• StoryPlan uses passwordless e-mail authentication via Logto
• You are responsible for the security of your e-mail account

• Each user may only have one active account
• Sharing accounts is prohibited
• We reserve the right to terminate duplicate accounts

You retain ownership of all content you create in StoryPlan, including:

• Journal entries
• Chat conversations
• Plans and reflections
• Any other content you input

By using StoryPlan, you grant us a limited license to:

• Store your content securely on our servers
• Process your content through AI services (Anthropic Claude) to provide coaching responses
• Display your content back to you in the application

We will never:

• Sell your content to third parties
• Use your content for advertising
• Share your journal entries publicly
• Train AI models on your private content

You agree NOT to use StoryPlan for:

• Illegal activities: Violating any applicable laws or regulations
• Harmful content: Creating content that is defamatory, harassing, or promotes violence
• System abuse: Attempting to hack, breach security, or overload our systems
• Spam or automation: Using bots or automated tools to access the service
• Commercial resale: Reselling or redistributing StoryPlan without permission
• Impersonation: Pretending to be someone else or misrepresenting your affiliation

Violation of these terms may result in immediate account termination.

StoryPlan uses AI (Anthropic Claude) to provide coaching and suggestions.

Important Disclaimers:

If you need professional advice, consult a qualified expert in the relevant field.

All rights, title, and interest in StoryPlan (excluding your content) are owned by us, including:

• Website design and user interface
• Software code and architecture
• Brand name, logo, and trademarks
• Documentation and marketing materials

You may not:

• Copy, modify, or reverse engineer our platform
• Remove or alter any copyright notices
• Use our trademarks without permission

As stated in Section 4, you retain all rights to your content. StoryPlan does not claim ownership of your journal entries, conversations, or creative work.

• Billing is handled via Stripe
• Prices are in USD and subject to change
• You will be notified of price changes in advance

• Credit balance is non-refundable

• You are responsible for any applicable taxes
• Prices do not include VAT or sales tax where applicable

We strive to provide reliable service but cannot guarantee 100% uptime. StoryPlan may be unavailable due to:

• Scheduled maintenance (we'll notify you in advance)
• Technical issues or outages
• Force majeure events beyond our control

We reserve the right to:

• Modify or discontinue features
• Update the service to improve functionality
• Change these Terms (with notice to users)

We will provide reasonable notice for significant changes.

Your use of StoryPlan is governed by our Privacy Policy, which explains:

• What data we collect
• How we use and protect your data
• Your rights under GDPR
• How to export or delete your data

Key Privacy Commitments:

• EU-based data storage (Stockholm, Sweden)
• Anthropic Claude does not train on your data
• You can export or delete your account anytime

You may terminate your account at any time by:

1. Going to your account settings
2. Clicking "Delete Account"
3. Confirming your email address

Upon termination:

• Your data enters a 30-day grace period (you can recover it)
• After 30 days, all data is permanently deleted
• Credit balance is forfeited

We may suspend or terminate your account if:

• You violate these Terms
• You engage in prohibited activities
• Your account is inactive for extended periods
• We discontinue the service entirely

We will provide notice when possible, but may terminate immediately for serious violations.

STORYPLAN IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

You use StoryPlan at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the service
• Damages exceeding the amount you paid to StoryPlan in the past 12 months

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless StoryPlan from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your content or activities on the platform
• Your violation of any third-party rights

These Terms are governed by the laws of Sweden.

Informal Resolution: If you have a dispute, please contact us first at legal@nitwit.se. We'll try to resolve it amicably.

Jurisdiction: For legal proceedings, courts in Stockholm, Sweden shall have exclusive jurisdiction.

We may update these Terms from time to time. When we do:

• We'll update the "Last Updated" date at the top
• We'll notify you via email for significant changes
• Continued use after changes constitutes acceptance

If you don't agree to the updated Terms, you must stop using StoryPlan.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StoryPlan.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Our failure to enforce any right or provision does not constitute a waiver of that right.

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

We are not liable for delays or failures due to circumstances beyond our reasonable control.
